These terms apply to your use of waterdamagenewyork.org (the Website) and to any request you make through it. Please read them before you use the site.
Using the Website
The Website exists to put you in touch with independent water damage restoration contractors working across the five boroughs of New York City. Use it for lawful purposes only. Do not interfere with the site, probe it for weaknesses, scrape it, or submit anything that is false, abusive or unlawful. You must be 18 or over to send a request.
What We Do
We are a referral service. When you call or send a request, we pass your details to an independent restoration contractor in our network that covers your borough, and we may receive a fee from that contractor for the referral. We do not perform water extraction, drying, mold assessment, mold remediation, plumbing, or repair work ourselves, and we do not employ, supervise or insure the contractors who do.
Any agreement for work is between you and the contractor who attends. That contractor sets its own terms and prices, carries its own licenses and insurance, and is solely responsible for the quality, timing and outcome of the work. We give no warranty about any contractor or any result.
Your Responsibilities
By using the Website you agree to:
- Give accurate contact details and an accurate account of what has happened at the property
- Check the contractor’s licenses before work begins, including the New York City Department of Consumer and Worker Protection Home Improvement Contractor license where it applies and, for mold work above ten square feet, the New York State Department of Labor mold licenses
- Agree the scope of work and the price with the contractor in writing before work starts
- Obtain any consent your building, co-op board, condo board, landlord or management company requires before work begins
- Take any dispute about the work directly to the contractor that performed it
Emergencies
Nothing on the Website replaces the emergency services. If there is a risk to life, a gas smell, a structural collapse risk, live electrical hazard or a steam release, contact 911, the utility or your building staff first. Information on the Website is general guidance about water damage in New York City. It is not advice about your specific property, your lease, your insurance policy or your legal position, and it is not legal advice.
Content and Intellectual Property
The text, images, diagrams and design of the Website belong to us or are used under license and are protected by copyright. Do not copy, republish or adapt them without written permission, which can be requested by phone on (929) 477-6429 or through the contact form.
Limitation of Liability
To the fullest extent the law allows, we are not liable for any loss or damage arising from your use of the Website or from work carried out by any contractor you were connected with. That includes property damage, further water or mold damage, loss of use, lost income, lost data and consequential loss, whether or not we were told such loss was possible. Our role begins and ends with the referral.
Indemnity
You agree to indemnify us against any claim, loss, liability or reasonable legal cost arising from your use of the Website, from a breach of these terms, or from your dealings with any contractor we connected you with.
Third-Party Links
The Website refers to and links to third-party resources, including New York City and New York State agencies. We do not control those sites and are not responsible for their content or their handling of your data.
Suspending or Ending Access
We may restrict or withdraw access to the Website at any time, without notice, where these terms have been broken or where use of the site is causing harm.
Changes
These terms may be revised. The current version is always the one on this page, with its date at the top. Continued use after a revision means you accept it.
Governing Law
These terms are governed by the law of the State of New York. Any dispute arising from them will be heard in the state or federal courts sitting in New York County, New York.
